The ASF has made a submission in response to ASIC’s consultation (CPS 325) – product design & distribution obligations under Part 7.8A Corporations Act (DDO provisions) – seeking an exclusion from the DDO provisions when a lender of record is a special purpose securitisation trusts solely because it enters into a credit facility with a retail customer. This contractual arrangement should not be treated as “retail product distribution conduct” under the DDO provisions.
